The website is owned by the Asociación Española de Comisionados de Filmaciones, Cine y Televisión (hereinafter, “Spain Film Commission“), with NIF G-91136770, with registered office at Avda. Menéndez Pelayo 12, 6D, 41004, Sevilla (Spain), and registered in the National Register of Associations with the national number 168752 since 17 December 2001 .

The website with URL www.spainscreentourism.com (hereinafter, the “Website“) provides access to information and content related to the activity of Spain Film Commission and its collaborators (hereinafter, the “Content“).

This Legal Notice (hereinafter, the “Legal Notice“) establishes the conditions that regulate the use of the Content that Spain Film Commission makes available to users free of charge through the Website. 

Thus, access to and use of the Website implies that the user of the same (hereinafter, the “User“) accepts in its entirety and is obliged to comply fully with this Legal Notice, as well as the Privacy Policy and the Cookies Policyas well as other terms and conditions that may be indicated in a specific section or initiative of the Website.

The User assumes responsibility for the use of the Website. This responsibility extends to any registrations that may be necessary to access certain services or content. In such registrations, the User will be responsible for providing truthful and lawful information. The User undertakes to make appropriate use of the Contents that Spain Film Commission offers through the Website and, including but not limited to:

  • Not to carry out any conduct that could damage the image, interests and rights of Spain Film Commission or third parties;
  • Not to remove, evade or manipulate the copyright and other data identifying the rights of the owners incorporated into the Contents of the Website, as well as the technical protection devices, or any information mechanisms that may be included in said contents;
  • Not to carry out any act with the aim of damaging, rendering useless or overloading the website or in any way impeding the normal use and operation of the same.

 

Spain Film Commission reserves the right to make, at any time and without prior notice, modifications and updates to the website and its contents, configuration and presentation, including this Legal Notice, so we recommend that you read it before accessing and browsing the website. Spain Film Commission will place this Legal Notice in a visible place, freely accessible for any queries you may wish to make.

In the event of a breach of this Legal Notice or in the event that Spain Film Commission reasonably suspects that such a breach is taking place, Spain Film Commission reserves the right to limit, suspend or terminate the User’s access to the Website. Likewise, Spain Film Commission reserves the right to decide, at any time, on the continuity of the Contents offered through the Website.

 

  1. Policy on links to other Internet sites

The Website may include technical linking devices (links) that allow the User to access other Internet pages and portals that are not owned by Spain Film Commission (hereinafter, “Linked Sites“).

In these cases, Spain Film Commission will not be responsible for the content and services provided on the Linked Sites if it does not have effective knowledge that the activity or information to which it refers or which it recommends through its links is illicit or harms the property or rights of a third party susceptible to compensation or, if it does have such knowledge, it acts diligently to remove or disable the link or the corresponding information.

The existence of Linked Sites in no way implies that Spain Film Commission has effective knowledge or any other type of knowledge of the services and contents of the same in the event of unlawfulness, nor that it necessarily maintains agreements with those responsible for or owners of the Linked Sites. The User is solely responsible for checking and accepting the contents, conditions of use and privacy policies of the Linked Sites each time he/she accesses and uses them.

In the event that the User considers that there is a Linked Site with illegal or inappropriate content, please inform Spain Film Commission through the contact details indicated in this Legal Notice. Under no circumstances will this notification entail the obligation to remove the corresponding link.

 

  1. Intellectual property rights 

Spain Film Commission, by itself or as an assignee, is the owner of all intellectual and industrial property rights of the Website and its Contents, as well as of the elements that comprise it (including but not limited to images, sound, audio, video, applications or texts, trademarks or logos, colour combinations, structure and design, selection of materials, computer programmes necessary for its operation, access and use, etc.), owned by Spain Film Commission or by its licensors and, as such, they constitute works protected by the intellectual and industrial property regulations in force. 

Pursuant to the provisions of Royal Legislative Decree 1/1996, of 12 April, which approves the revised text of the Intellectual Property Law, regularising, clarifying and harmonising the legal provisions in force on the matter, the reproduction, transformation, distribution, public communication -including its mode of making available-, extraction and/or reuse of all or part of the Contents and/or distinctive signs of Spain Film Commission for commercial purposes, in any medium and for any purpose whatsoever, are expressly prohibited, public communication -including making available-, extraction and/or reuse of the Website, all or part of the Contents and/or the distinctive signs of Spain Film Commission for commercial purposes, in any medium and by any technical means, without the prior written authorisation of Spain Film Commission, are expressly prohibited. The User undertakes to respect the intellectual and industrial property rights owned by Spain Film Commission.

The use of the Website by the User in no way implies the transfer of any intellectual and/or industrial property rights over the Website, the Contents and/or the distinctive signs of Spain Film Commission. All the Contents published on the Website and, especially, the designs, texts, images, videos, graphics, logos, icons, buttons, as well as the commercial names, brands or drawings and any other sign susceptible of industrial and commercial use, are subject to the intellectual and industrial property rights of Spain Film Commission. Under no circumstances shall it be understood that any licence is granted or that any waiver, transfer, total or partial assignment of said rights is made, nor is any right or expectation of right conferred and, in particular, of alteration, exploitation, reproduction, distribution or public communication of said contents without the prior express written authorisation of Spain Film Commission.

 

  1. Limitation of liability 

Spain Film Commission applies, in compliance with personal data protection regulations and other applicable provisions, the appropriate technical and organisational measures to guarantee an adequate level of security of the website.

In this sense, Spain Film Commission manages its server environment appropriately, having a strictly compliant firewall infrastructure and continuously uses current technologies to ensure that the confidentiality and privacy of information is not compromised.

The User acknowledges and accepts that the use of the Website is at all times at his/her own risk and responsibility, and therefore Spain Film Commission accepts no responsibility for any misuse or improper use that may be made of it.

Spain Film Commission will not be liable for damages that the User may suffer as a result of the use of the Website, unless damages directly attributable to an incorrect action of this entity are proven, having proven a breach of the legal and regulatory demands and requirements established. It is the User’s responsibility to adopt all appropriate technical measures to reasonably control the risks of open Internet browsing and to avoid damage to their equipment, loss of data and theft of confidential information.

For its part, by way of example but not limited to, Spain Film Commission is not responsible for:

  • Damages that may arise from interferences, omissions, interruptions, computer viruses, breakdowns and/or disconnections in the operational functioning of the Website or in the User’s computer devices and equipment caused by reasons beyond the control of Spain Film Commission, which prevent or delay the provision of services or browsing of the Website.
  • Delays or blockages in use caused by deficiencies or overloading of the Internet or other systems, or the impossibility of providing the service or allowing access for reasons not attributable to Spain Film Commission, due to the User, third parties or force majeure.
  • The use that the User may make of the Contents of the Website, whether prohibited or permitted, in infringement of the intellectual and/or industrial property rights of the Contents of the Website or of third parties.
  • The acts or omissions of third parties, regardless of whether these third parties may be contractually bound to Spain Film Commission.

In any case, Spain Film Commission undertakes to adopt the appropriate measures to try to solve the problems that may arise and to offer all the necessary support to the User in order to reach a quick and satisfactory solution to the incident.

 

  1. Jurisdiction and applicable law 

The law applicable to this Legal Notice shall be Spanish law. Any disputes that may arise between the User and Spain Film Commission shall be resolved by the competent courts and tribunals in accordance with the applicable legislation.

From time to time, this Legal Notice may be revised in order to update changes in current legislation, update our procedures for collecting and using information or due to the appearance of new services or the exclusion of others.
